Mesothelioma is a rare form of cancer caused primarily by asbestos.

Up until the late 1970’s the harmful effects of asbestos were relatively unknown. Asbestos appeared as though a great product that was not only fire-resistant, but it was incredibly strong, and that’s why it was the go-to product for manufacturing building materials.

When the danger of using asbestos become widely known, it was already too late. Many residential and commercial dwellings already contained asbestos.

People became exposed to asbestos through a variety of sources. A few examples include:

  • Plaster
  • Siding on the exterior of homes and buildings
  • Wall Insulation
  • Thermal seals
  • Piping and insulation
  • Roof shingles
  • Duct insulation
  • Textured paints
  • Joint compound

There is no definite cure for mesothelioma. It is an aggressive form of cancer that typically affects the lungs. Inhaling microscopic fibers of asbestos can also lead to asbestosis, a breathing disorder.

Should You File A Claim?

If you were exposed to asbestos and developed mesothelioma or other health related issues, you may have a few options for filing a claim.

You can file a traditional lawsuit.

A victim may be able to file a personal injury or wrongful death lawsuit if they developed asbestos-related diseases as a result of being exposed to asbestos.

You can file an asbestos trust fund claim.

Asbestos trust funds are organized by bankrupt companies and are there to provide monetary compensation for people who developed asbestos-related diseases due to asbestos exposure.

You could file a workers’ compensation claim.

If a person was exposed to asbestos in their workplace and later developed health problems such as mesothelioma or asbestosis, they may be able to file a workers’ compensation claim.

Veterans may be eligible for healthcare claims and may be able to file disability.

Personal injury and wrongful death lawsuits and litigation are effective ways to hold negligent manufacturing companies liable. It is also a way for injured parties to obtain compensation for damages due to healthcare costs, lost wages, pain and suffering, and miscellaneous expenses. A court may also award punitive damages to mesothelioma victims as a way to punish the manufacturing company for their negligence.
