No-fault insurance

New York is a no-fault insurance state, meaning that insurance will pay for any economic losses incurred for any injured people involved in the auto accident regardless of who was at fault.

No-fault insurance protects individuals from personal injury claims. Injured parties can claim benefits from the insurance without having to prove that the other party was liable for the accident.

New York requires car driver’s to either have no-fault insurance at the time that they register their vehicle or that they have enough funds to pay for accident injuries out of pocket. New Yorkers must show proof that they carry no-fault insurance that provides a minimum of $50,000 in coverage for each person injured in the accident.

This does not mean that a personal injury lawsuit cannot be filed. Reading your policy carefully is extremely important as there are exclusions that apply. Additionally, any claims made to the insurance provider must be submitted before their deadline.

No-fault insurance covers many necessary and reasonable expenses including:

Ambulatory expenses

Medical expenses

Rehabilitation costs

Lost wages

Funeral costs

While a no-fault insurance policy holder may be entitled to benefits, the insurance company may deny their claim. When this happens, contacting an experienced personal injury attorney is important. They can help fight the insurance claim and may be able to get you the compensation you deserve.
